Complaint Process and Procedures

The South Dakota One-Call Notification Board carries enforcement authority of state excavation laws. SDCL 49-7A-17 allows for parties to file a complaint against parties who violate excavation laws. SDCL 49-7A18, 49-A7-19 and 49-7A-20 provides for civil penalties for failure to comply with Statutes and Administrative Rules which can be found HERE. Be advised you may be required to obtain legal counsel during part of this process.

Complaints and Responses may be filled electronically, which is the method preferred by the South Dakota One-Call Board. When applying online it’s recommended to take a screenshot of the completed form and save for your records. Make certain to click SUBMIT at the bottom of the form when done. If you do not receive an email confirmation within one hour, contact codi@sd811.com.

You may also file a complaint or respond to a complaint by mail. Send to: South Dakota One-Call Notification Board, PO Box 187, Rapid City, SD 57709. Be sure to include which law was violated, details of the incident, copies of locate tickets (not just locate ticket numbers), pictures and other pertinent information to support your claim or provide your defense.
